FS Enterprises LLC – Terms of Service

These Terms of Service (“Terms”) govern your use of the mobile application provided by FS Enterprises LLC (“we,” “our,” or “us”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.

The App is designed solely to allow users to:

  • Submit their name and email address
  • Send an inquiry email about a book using the Gmail API
  • Optionally subscribe to quarterly update emails

You agree to use the App only for lawful purposes and in accordance with these Terms.

2. User Information and Responsibilities

To use the App’s inquiry feature, you must provide accurate and truthful information, including your name and email address. You agree not to:

  • Provide false or misleading information
  • Use another person’s email address without permission
  • Attempt to interfere with or disrupt the App’s functionality

3. Email Functionality

The App uses the Gmail API to send an inquiry email that you initiate. By using this feature, you authorize the App to send an email on your behalf for the sole purpose of contacting FS Enterprises LLC regarding a book inquiry.

The App does not access your inbox, contacts, or any other Gmail data.

4. Optional Quarterly Updates

You may choose to opt in to receive quarterly update emails. If you opt in:

  • Your name and email will be securely stored
  • You may unsubscribe at any time by contacting us

If you do not opt in, your information is not retained after your inquiry email is sent.

5. Intellectual Property

All content, features, and functionality of the App—including text, graphics, logos, and software—are owned by FS Enterprises LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

6. Prohibited Conduct

You agree not to:

  • Use the App for any purpose other than book inquiries or optional updates
  • Attempt to reverse engineer, decompile, or modify the App
  • Interfere with the App’s servers, security, or network
  • Use the App in any way that violates applicable laws or regulations

7. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the App’s operation, availability, or suitability for your intended use. We do not guarantee that the App will be error‑free or uninterrupted.

8. Limitation of Liability

To the fullest extent permitted by law, FS Enterprises LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App will not exceed the amount you paid to use the App, if any.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

10. Third‑Party Services

The App uses the Gmail API to send emails. Your use of Gmail services is subject to Google’s terms and policies. We are not responsible for Google’s actions, availability, or service performance.

11. Termination

We may suspend or terminate your access to the App at any time if we believe you have violated these Terms or engaged in unlawful or harmful behavior. You may stop using the App at any time.

12. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted within the App with an updated “Effective Date.” Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict‑of‑law principles. Any disputes must be resolved in the state or federal courts located in Maryland.
